Working for fireworks factory for 9 days = Staying in prison for 11 years?
Anhui (located in middle China) changes an over-sentenced original judgement.
50 year-old Anhui farmer Lu Zhenquan was employed of making firecrackers for 9 days, without resulting the serious social consequence, he was sentenced by the court by the illegal manufacture explosive material crime for 11 years in the first trial. Recently, the Chuzhou intermediate people's court in the second trial sentenced Lu Zhenquan to imprisonment for 3 years, suspends sentence for 5 years.
On April 7, 2003, Lu Zhenquan got the employment by boss Lu Yuanping to make the fireworks firecracker in Quanjiao County, Anhui. On April 17, the factory Lu Zhenquan was working for was is sealed up by the local police station, Lu Zhenquan was arrested. On September 24, Quanjiao County local court decided to sentence to 11 year¡¦s imprisonment in the name of illegal manufacture explosive material crime. Lu Zhenquan family member believed that, making 9 days firecrackers for others and not creating any consequence, does not deserved to stay in jail for 11 years. It is unfair.
With Congressman Guan Shuqi¡¦s help, on November 28, 2003, in Chuzhou court second trials makes above change, on December 16, Lu Zhenquan gets the home.
Although the unfair decision has been changed, but Congressman Guan think we should denounce severely and punish this kind of obvious unfair judicature. Guan says that, Lu Zhenquan is an overly cautious and prudent farmer, in first trial he obtains a fast over sentences; But to the person who hires him, Lu Yuanping, the court still cannot make a decision yet. Lu Zhenquan obviously is employed, in this case he is only an accessory culprit at best, but the first trial court actually fuzzily writes the road "this case not to have the principal offender, also not to be able to branch out the accessory culprit". "If this case cannot obtain the attention, the result can be imagined." Congreeman Guan said it with heavy heart.
