Asbo call over bedroom intruder
A judge has called on police to take action after a court was unable to prosecute a man who entered a woman's house in Lancashire.
Dean Marie, 40, went into the house in Padiham, put on women's clothing and performed a sex act on the woman's bed, Burnley Crown Court heard on Tuesday.
The prosecution could not prove Mr Marie, of Colne Road, Burnley, had any intention of stealing anything.
Judge Andrew Gilbart said it was "a classic case for an Asbo".
" No-one is happy with this outcome but there is nothing I can do through the criminal courts "

He added: "I expect the police to apply to the magistrates' courts for such an order within a month."
He said the defendant had "intruded appallingly on someone's privacy" but the only power he had was to bind him over for the sum of £100 to be of good behaviour for a year.
Judge Gilbart ruled that a not guilty verdict be entered, saying the offence of burglary needed to show an intent to steal and there was no such evidence in this case.
The court was told Mr Marie broke into the woman's home last July as a trespasser without causing criminal damage. He was said to be carrying a piece of metal piping.
He went into her bedroom and performed a sex act on her bed, also touching some of her personal belongings.
The woman, who was not in at the time, was so distressed she had to move home, she had trouble sleeping and she was concerned for her safety of herself and her eight-year-old son.
David Pickup, for the prosecution, said he could not find an offence for the case to proceed.
"No-one is happy with this outcome but there is nothing I can do through the criminal courts to pursue this matter," he said.

In the United Kingdom and the Republic of Ireland[1] an Anti-Social Behaviour Order (acronym ASBO, pronounced az-bo) is a civil order made against a person who has been shown to have engaged in anti-social behaviour. In the United Kingdom, this is defined as "conduct which caused or was likely to cause alarm, harassment, or distress to one or more persons not of the same household as him or herself and where an ASBO is seen as necessary to protect relevant persons from further anti-social acts by the Defendant". [2] In England and Wales they are issued by Magistrates' Courts, and in Scotland by the Sheriff Courts. The UK government introduced ASBOs by the Crime and Disorder Act 1998.
In the UK, a CRASBO is a "Criminally Related" ASBO.[2]

Don't they have trespassing in England? Criminal damaging (I'd say those sheets are useless to her now)? Seems like they're not trying very hard. Either that or the prosecution botched the case and they're pretending it wasn't their fault.

I think he should be put to death. I mean, seriously, he put on her clothing (if not reason enough right there), violated her personal space, and performed some twisted sex act in HER bed. Hell, I'd give him a choice - either death, or to have his testicles and arms removed and placed in the four corners of London to discourage this kind of behavior. I thought the English were a little tougher than "there is nothing I (the prosecution) can do through the criminal courts to pursue this matter".

I don't know about the "criminal damaging" since she can surely just wash her sheets (granted, most people would throw the sheets away), but I would think some sort of criminal trespass or illegal entry would be a no-brainer. I would be shocked if England didn't have some laws against such activity.

OKAY!!! So it 'could' be an excuse to renovate...;D but I seriously would never sleep in that bed again...
I know someone who had her Mercedes parked in her driveway warming up before she left for work. Kids took it. When she got it back it was full of fast food wrappers but no damage. She still couldn't drive it. She felt violated...her security space had been infringed on she said. A car would be different for me... but the bedroom...THAT would bug me.

Reminds me of something a co-worker told me - when she worked at a Ford dealership it wasn't completely unheard for employees to do it in the new cars. I suppose those of us that have small cars are safe. Well, maybe not, I have a hatchback.

The article pointed out that the guy was not in any way intent on harming the people living there. The perpetrator obviously has some unresolved sexual feelings to sort out, but anyone who couldn't laugh this off and get on with their life has some sort of psychological problem, it seems to me.
The £100 fine and being bound over for good behaviour for a year seems a pretty reasonable punishment.
If it happened to me, i'd likely think --"Welp, now i've got another bizarre and funny story to tell my friends"

I don't know, Decka - I don't find someone who's afflicted with bestial necrophilia to be anywhere near as disturbing as the individual who dines on shit for pleasure.
Personally, I think both groups should be put to death, but that's JMO.
