Kathleen Sullivan is a noted constitutional scholar who has argued cases before the Supreme Court. Until recently, she was dean of Stanford Law School. In legal circles, she has been talked about as a potential Democratic nominee for the Supreme Court. But Ms. Sullivan recently became the latest prominent victim of California's notoriously difficult bar exam. Last month, the state sent out the results of its July test to 8,343 aspiring and already-practicing lawyers. More than half failed -- including Ms. Sullivan.

Of course it isn't her fault

But it's unusual for the exam to claim a top-notch constitutional lawyer at the peak of her game. "She is a rock star," says William Urquhart, who last year recruited Ms. Sullivan to join his firm, Quinn Emanuel Urquhart Oliver & Hedges LLP. "Practically every lawyer in the U.S. knows who Kathleen Sullivan is." If anyone should have passed, Mr. Urquhart says, it is Ms. Sullivan. "The problem is not with Kathleen Sullivan, it is with the person who drafted the exam or the person who graded it."

LOL... its not HER fault.... hey, everyone knows her name.. so she shouldnt have to pass the exam... right?

And wow, is my "Bush" sense tingling... i bet the lefties will bring up bush, saying he wasn't a great scholar either... and i agree, he was no einstein, but then again, he didn't fail out either.

And i'd also like to point out that lefties actually CANT bring up bush, because they always accuse conservatives of bringing up clinton to "change the subject"... well practice what you preach please.

No...I think I'd like to have a lawyer who passed...

You really have to stop pretending you know what "lefties", "libbies" and anyone else thinks.

BTW, I think that Lionel will tell you that not passing the bar exam doesn't mean you've "failed out".

Nonsense - anyone who fails the bar exam is a loser! :D

The problem is that these big thinker law people don't actually know how to do anything practical - they just sit around and think big thoughts. Or at least that's what those of us that attended non-elite law schools like to tell ourselves.

(For the record, I passed the two I've taken on the first try).
